Terms and Conditions

§1. Definitions

  1. Regulations – these terms and conditions for using the Service.
  1. Service – this website dedicated to presenting culinary blogs, content published within them, and all functions and tools provided by this Service.
  1. User – a person with full legal capacity who has gained access to the services specified in §2 of these Regulations by accepting them. A User can also be a minor and/or a person without full legal capacity, provided that they have obtained consent from their legal representative.
  1. Service Provider – Rafał Olkis conducting a business entity under the name ROFiO, REGON number 021906112.
  1. Act – the Act of July 18, 2002, on providing services electronically.
  1. Regulation – Regulation (EU) 2016/679 of the European Parliament and the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data.
  1. Premium – the paid version of the Service.

§2. General Provisions

  1. The Service acts as a search engine that indexes content published on culinary blogs through their RSS feeds.
  1. Content fragments are automatically downloaded and presented to Users as previews containing:
  • Title (with the possibility of minor modifications regarding orthography, punctuation, or style to improve presentation quality without altering the meaning),
  • Short description,
  • Tags assigned by the author or generated automatically,
  • A link to the source, enabling full access to the content on the author's website.
  1. Based on the right to quote, in accordance with Article 29 of the Act on Copyright and Related Rights, the Service allows for indexing and presenting content in a shortened form, without altering the original materials, solely for informational purposes and in compliance with the law.
  1. The Service does not modify content beyond minor corrections to the title (as stated in point 2) and is not responsible for their legality or reliability. The presented materials remain the property of their authors.
  1. Adding blogs to the Service by Users implies that the person adding them has the appropriate permissions or consents, if required, and that the added blogs comply with the theme of the Service.
  1. The Service complies with copyright laws.

§3. Scope of Services Provided

  1. As part of providing services electronically, Users are given access to software enabling:
  • Searching for culinary blogs,
  • Browsing the index of blogs and content,
  • Adding new blogs to the index,
  • Participating in culinary actions organized by the Service,
  • Engaging in forum discussions and commenting under blogs,
  • Saving content to favorites,
  • Sharing saved content with other Users.
  1. The Service is free to use and may display advertisements to fund its activities. Users can purchase an optional Premium subscription, which grants:
  • Disabling advertisements across the entire site,
  • Faster webpage loading and improved Service performance,
  • Special highlighting of their profile and, if needed, their blog.

§4. Content Published on Blogs

  1. All content published on blogs available in the Service is added under the sole responsibility of their authors.
  1. The Service is not liable for the content posted on blogs, including its compliance with the law, accuracy, and truthfulness.
  1. Users who add blogs to the Service are fully liable for copyright and other intellectual property rights related to the content they publish. Users commit to adding only content for which they have appropriate rights or agreements. The Service is not responsible for any violations of these rights by Users.

§5. Prohibited Activities

  1. It is prohibited to engage in activities that are illegal, immoral, socially unacceptable, or that violate netiquette, including:
  • Adding blogs or content containing materials that are illegal, incite hatred, promote violence, violate personal rights or copyrights,
  • Adding blogs or content inconsistent with the theme of the Service.

§6. Adding Blogs to the Index

  1. The condition for adding a blog to the Service's index is that its content aligns with the culinary theme.
  1. The User can submit a blog to the Service in two ways:
  • By placing a verification banner on it,
  • Without placing a banner.
  1. After placing the verification banner and completing the blog verification process, the User's account will automatically be upgraded to a Premium account at no additional charge.
  1. The Service reserves the right to refuse the addition of any blog that does not meet the requirements set forth in these Regulations.

§7. Liability and Limitations

  1. The Service will make every effort to ensure proper operation, reliability, and availability of its features.
  1. The Service reserves the right to suspend its operation in cases where technical work is required.
  1. The Service is not responsible for service interruptions caused by external factors, such as Internet network failures, external service provider issues, hosting provider malfunctions, or force majeure.

§8. Personal Data and Privacy Policy

  1. The administrator of Users' personal data is the Service Provider.
  1. Users' personal data is processed for the purposes of service provision, in accordance with the Regulation and other legal provisions, including the Personal Data Protection Act.
  1. Detailed information on data processing can be found in the Privacy Policy document available in the website footer.

§9. Changes to Regulations

  1. The Regulations may be amended, and Users will be informed at least 7 days before the changes come into effect.
  1. Such changes will become effective 7 days after their publication on the Service's website unless the User agrees to their earlier application.
  1. In case of non-acceptance of the amended Regulations, the User has the right to terminate the service provision agreement.

§10. Final Provisions

  1. The Regulations enter into force on the day of publication on the Service's website.
  1. In the event of disputes arising from the service provision agreement, the parties will seek to resolve them amicably, primarily through mediation. If no agreement is reached during mediation, the dispute will be resolved by court proceedings or, if the parties agree, by an arbitral tribunal competent for the location of the Service Provider.
